Some of the most common issues that arise post-purchase are construction problems, involving substandard building work or structural defects. Poveda Hayes has an impressive track record of taking effective action against contractors and builders in such cases, ensuring a successful outcome for our clients, carried out within the strict time limits imposed by Spanish law.
We have also helped many clients with problems involving the shared ownership of communal elements in properties with multiple residents, such as multi-storey buildings or residential complexes. Such properties in Spain are usually managed by the residents via the use of ‘Community Meetings’ with decisions affecting the shared property being taken by the residents as a whole. This is very different to the system of delegating the running of the building to a management company, as usually employed throughout the British Isles. The Spanish-style ‘Community’ management can often lead to issues and disputes, particularly with the law governing this area being very broad. A commonly publicised post-purchase issue, normally encountered in the absence of independent legal advice from the outset, is where a buyer discovers problems with building and/or planning licences involved with their property after they have already signed a contract of purchase.
